1. Acceptance of Terms
By accessing and using the indexjk.com platform, operated by Indexjk S.R.L., you accept these terms and conditions in their entirety. If you disagree with any part of these terms, we ask that you not use our services. These terms constitute a binding agreement between you (the user) and Indexjk S.R.L. Continued use of the platform after any modification implies acceptance of the updated terms.
2. Service Description
Indexjk operates a real estate crowdlending platform that connects people interested in participating in property projects with project promoters. The platform facilitates collective financing of real estate projects in Bolivia, providing information, management tools, and participation mechanisms. Indexjk acts as a technology intermediary and not as a regulated financial entity.
3. Eligibility
To use Indexjk's services, you must be over 18 years old, have legal capacity to enter binding contracts under Bolivian law, reside in Bolivia or in a country where accessing crowdlending services is legal, and provide truthful, complete, and up-to-date information during the registration process. We reserve the right to verify user identity and deny access to those who do not meet the established requirements.
4. Project Participation
Participation in real estate projects through the platform involves financial risks. We do not guarantee returns or recovery of participated capital. Each project has its own terms, timelines, and conditions detailed in its specific documentation. Before participating, it is your responsibility to review all available information, assess the risks, and, if you deem it necessary, consult with an independent financial advisor. Participation decisions are your sole responsibility.
5. User Obligations
As a platform user, you commit to providing and maintaining truthful personal information, using the platform exclusively for the purposes outlined in these terms, not attempting unauthorized access to platform systems or data, not conducting activities that could compromise the security or integrity of the platform, and complying with all applicable laws and regulations in Bolivia. Breach of these obligations may result in suspension or cancellation of your account.
6. Fees and Costs
Indexjk may charge fees for services provided through the platform. Applicable fees will be detailed transparently before you confirm your participation in any project. We reserve the right to modify fees with prior notice. Applicable taxes under Bolivian tax legislation are the responsibility of each user.
7. Intellectual Property
All content on the indexjk.com platform, including texts, graphics, logos, icons, images, software, and design, is the property of Indexjk S.R.L. or its licensors and is protected by Bolivia's intellectual property laws and international treaties. Reproduction, distribution, modification, or commercial use of any platform content without prior written authorization is not permitted.
8. Limitation of Liability
Indexjk provides the platform as a technology intermediary and is not responsible for investment decisions made by users, financial outcomes of real estate projects, temporary service interruptions due to maintenance or force majeure, or actions or omissions of third parties involved in projects. To the maximum extent permitted by Bolivian law, Indexjk's total liability shall be limited to the amount of fees paid by the user in the last twelve months.
9. Dispute Resolution
Any dispute arising from these terms or the use of the platform shall preferably be resolved through direct negotiation between the parties. If no agreement is reached, the parties shall submit to a mediation process before the Conciliation and Arbitration Center of the National Chamber of Commerce of Bolivia. If the dispute persists, it shall be resolved by the competent courts of the city of La Paz, Bolivia.
10. Applicable Law and Final Provisions
These terms are governed by the laws of the Plurinational State of Bolivia. If any provision of these terms is declared null or unenforceable, the remaining provisions shall maintain their full force and effect.
